    Terms & Conditions
    This agreement ("Agreement") is between Burning Moth Creations, Inc. ("Burning Moth") and the individual or group ("Client") purchasing the $500 Website Special provided by Burning Moth ("Offer"). I. DEFINITION & COSTS 1. The Offer is defined as a) one website ("Website") including domain name, website design template, content management interface, contact form, interactive map, email address and data that comprise the website; and b) optional features and services listed with and for the purpose of augmenting the Offer selected by the Client ("Options"); and c) Website administration ("Management") including website hosting, domain name registration, software updates, configuration and data administration; and d) initial input of Website content data including but not limited to text, images and other media ("Content"). 2. The cost of the Offer ("Cost") is charged at a) $500 USD in full and up front; plus b) $60 USD ($5 USD per month) billed annually after the first year; plus c) any additional charges for Options. 3. Regular service rates apply for products and services requested by the Client beyond the scope of the Offer including but not limited to digitizing media, content production, custom software development or subscriptions to third party vendors. II. RESPONSIBILITIES 1. Content is provided in digital format by the Client. 2. Management is provided by Burning Moth. III. OWNERSHIP RIGHTS 1. Rights to Content, website design template and domain name belong to the Client. 2. Rights to imagery and technologies used to build the Website ("Technologies") belong to their respective owners. IV. REFERRAL REWARDS 1. Reward ("Reward") is a $50 Visa gift card payable to one individual ("Referrer") acknowledged by the Client within 90 days of remitting payment to Burning Moth towards the Offer as recommending the Offer to the Client. 2. Reward is payable to Referrer 90 days after the Client has remitted payment to Burning Moth. 3. The Referrer cannot be the Client. 4. One Reward is payable per Client. V. REFUNDS 1. The Client is entitled to a refund for 90 days from the date payment is remitted to Burning Moth. 2. Refunds do not include Options charged periodically or products or services provided beyond the scope of the Offer. 3. Refunds are issued in the manner payment was received. VI. TERMINATION 1. The Agreement is terminated in the event a) the Client elects to have the Website upgraded beyond the scope of the Offer, b) the Client elects to have an agency other than Burning Moth perform Management, c) or a refund is issued to the Client. 2. Upon termination of the Agreement all regular service rates apply. VII. MISCELLANEOUS 1. The terms of this Agreement may be changed by Burning Moth with notice. 2. Nullification of any provision of this Agreement does not void the other provisions set forth in this Agreement. Revision 5/4/2012
